At MW Homecare Services, we are committed to protecting the privacy and  security of our clients, families, caregivers, and website visitors.  This document outlines our practices regarding the collection, use, and  disclosure of personal information, federal HIPAA health privacy  standards, as well as the terms governing our mobile text messaging  (SMS) services.

We collect personal information that you voluntarily provide to us  when you fill out an application form, submit a client intake referral,  contact us for services, or communicate with us through our website.  This information may include:


  • Identifiers: Full name, physical mailing address, email address, phone number, and ZIP code.


  • Professional/Employment Information (for Caregivers): Job history, certifications (CNA, STNA, HHA), references, availability, driving limitations, and driver's license details.


  • Health and Care Needs (for Clients): General care requirements, household preferences, and family representative contact details.

We use the information we collect for the following business purposes:


  • To coordinate personal home care services and match caregivers with clients.


  • To process employment and independent contractor applications, run background checks, and verify professional credentials.


  • To communicate with you regarding schedules, administrative updates, and service changes.


  • To process billing, invoicing, and service documentation.


  • To send operational, scheduling, and emergency alerts.

We do not sell, rent, or lease your personal information to third parties. We only share your information with:


  • Authorized Administrative Personnel & Nurses: To coordinate and monitor care quality.


  • Service Providers: Trusted partners who assist us in operating our software, payroll,  background screening, and communications (such as our clinical  documentation platforms and electronic messaging services). These  partners are legally bound to keep your information confidential.


  • Legal & Regulatory Authorities: When required by state or federal law, Medicaid auditing guidelines, or to protect the safety of our clients and staff.

MW Homecare Services does not share, sell, rent, or lease SMS  consent, mobile phone numbers, or originator opt-in data with third  parties, affiliates, or partners for marketing, promotional, or any  other purposes. All of the above categories exclude text messaging  originator opt-in data and consent; this information will not be shared  with any third parties or affiliates under any circumstances. 

PART 2: HIPAA & PROTECTED HEALTH INFORMATION (PHI) POLICY

For our clients and family representatives, the protection of your  Protected Health Information (PHI) is governed by the Health Insurance  Portability and Accountability Act (HIPAA). 

1. Use and Disclosure of PHI

Your PHI may be used and disclosed by MW Homecare Services for the following essential purposes:


  • Treatment: To coordinate, plan, and deliver your personal home care services among our caregivers, nurses, and supervisors.


  • Payment: To process claims, verify coverage, and submit invoices to Medicaid, insurance payers, or private billing entities.


  • Healthcare Operations: To support administrative operations, quality assessments, caregiver  training evaluations, and state licensing compliance audits.

2. Circumstances for Disclosure Without Consent (45 CFR § 164.512)

In accordance with federal regulations under 45 CFR § 164.512,  we are permitted or required to disclose PHI without your written  consent in specific legal and public health situations, including:


  • When required by federal, state, or local law.


  • For public health activities, such as preventing or controlling disease or reporting abuse, neglect, or domestic violence.


  • For health oversight activities, such as state Medicaid audits, provider investigations, and regulatory inspections.


  • In response to a court order, administrative order, warrant, subpoena, or other lawful judicial processes.


  • To prevent or lessen a serious and imminent threat to the health or safety of a person or the general public.

3. Client and Representative Privacy Rights

Under HIPAA guidelines and MW Homecare Services policies, you hold the following rights:


  • Notice of Privacy Practices: You have the right to review and receive a copy of our full Notice of Privacy Practices before signing any consent form.


  • Restriction Requests: You have the right to request restrictions on how we use or disclose  your PHI for treatment, payment, or healthcare operations. While we are  not legally required to agree to every restriction request, we will  accommodate all reasonable and compliant requests.


  • Revocation of Consent: You have the right to revoke your HIPAA consent at any time. Revocation  must be submitted in writing, signed, and dated. Revocation will not  apply to any disclosures already made in reliance on your previous  consent. Please note that if you revoke consent to use your PHI for  treatment and billing operations, we will no longer be obligated to  provide home care services to you.


  • Right to File a Complaint: If you believe your privacy rights have been violated, you have the  right to file a formal complaint directly with MW Homecare Services or  with the Secretary of the U.S. Department of Health and Human Services  (HHS). We enforce a strict zero-retaliation policy for any complaints  filed.

PART 3: SMS TERMS & CONDITIONS (TERMS OF SERVICE)

By opting into mobile text messaging (SMS) from MW Homecare Services  through our online web forms, application portals, or by directly  messaging us, you agree to receive SMS alerts, operational messages, and  transactional communications from us. 

1. What to Expect (Types of Messages)

Our text messaging system is used strictly for operational and administrative purposes. You can expect to receive:


  • For Caregivers: Scheduling notifications, shift opportunities, upcoming shift  reminders, emergency schedule updates, and operational policy checks.


  • For Clients & Families: Appointment reminders, schedule changes, nurse on-call check-ins, and office closure announcements.


Please note: We do not send marketing, promotional, or sales-related text messages.

2. Messaging Frequency

The frequency of text messages varies based on your active schedules,  open case opportunities, and operational needs. You will only receive  messages relevant to your active relationship with our agency. 

3. Message and Data Rates May Apply

As is standard with mobile carrier services, message and data rates may apply for any messages sent to you from us or from you to us. Please contact  your mobile service provider for details on your specific texting plan. 

4. How to Opt Out (STOP)

You can choose to stop receiving text messages from us at any time.  To opt out, simply reply to any text message we send with the word STOP.


Once you send the keyword STOP,  you will receive a one-time automated text confirming that you have  been unsubscribed. After this confirmation, you will no longer receive  SMS messages from us. To opt back in at any time, simply text the word START to our number.

5. How to Get Assistance (HELP)

If you are experiencing issues with our text messaging service or  have questions, you can get assistance at any time by replying to our  messages with the word HELP.
